This Acceptable Use Policy ("AUP") governs Customer's use of all Qilak Services and is incorporated by reference into the Master Services Agreement. Capitalized terms not defined here have the meaning given in the MSA.
Violating this AUP may result in suspension or termination of Services under Section 12 of the MSA. Qilak will use commercially reasonable efforts to give notice before suspension, but may suspend immediately without notice where the violation creates a security, legal, or operational risk to the Qilak network or other customers.
1. Prohibited Content
Customer must not use the Services to host, store, transmit, distribute, or link to:
a. Child sexual abuse material (CSAM). Any such content is reported to the Canadian Centre for Child Protection (Cybertip.ca) and law enforcement as required by Canadian law. Accounts are terminated immediately and data preserved for investigation.
b. Content that incites violence, terrorism, or genocide, or that promotes or facilitates terrorist activity as defined under the Criminal Code of Canada.
c. Content that violates the Criminal Code of Canada, including but not limited to non-consensual intimate imagery, hate propaganda under sections 318–320, and obscenity offences.
d. Content that infringes third-party intellectual property rights, including copyright, trademark, patent, trade secret, or moral rights. Repeat infringers will be terminated.
e. Content that violates a third party's right to privacy or publicity, including doxing.
f. Defamatory, fraudulent, or deceptive content, including phishing pages, scam sites, and content designed to impersonate another person or entity without authorization.
g. Malware, including viruses, worms, trojans, ransomware, spyware, rootkits, cryptominers deployed without consent, or any code designed to disrupt, damage, or gain unauthorized access to systems.
2. Prohibited Activities
Customer must not:
a. Attack other systems. Engage in unauthorized access attempts, port scanning of third-party networks, denial-of-service attacks, brute-force attacks, credential stuffing, or any activity that violates the Criminal Code provisions on unauthorized use of computers (s. 342.1) or mischief in relation to data (s. 430).
b. Send unsolicited bulk communications. Send spam, unsolicited commercial email, or any messages in violation of Canada's Anti-Spam Legislation (CASL), the CAN-SPAM Act, the GDPR, or equivalent laws in any jurisdiction where recipients are located. This includes operating mailing lists without verified opt-in consent.
c. Threaten or harass. Make threats of violence, DDoS, or doxing against any person or entity. Threats targeting Qilak, its staff, or other customers will result in immediate termination.
d. Circumvent security. Attempt to bypass authentication, rate limiting, IP restrictions, or any other security measure protecting the Services or any third-party system.
e. Abuse Qilak resources. Use the Services in a manner that materially degrades performance for other customers, including cryptomining on shared resources, deliberate resource exhaustion, or use of "unlimited" or "unmetered" features in a manner inconsistent with normal commercial use.
f. Engage in fraud. Including credit card fraud, identity theft, account takeover, the sale or trade of stolen credentials, or operation of account generators.
g. Distribute illegitimately obtained codes. Including stolen, generated, or otherwise unauthorized game codes, license keys, gift codes, software activation codes, or hardware activation codes.
3. Network Use
a. Fair use of unmetered resources. Where a Service is described as "unlimited" or "unmetered," Customer is expected to use it in a manner consistent with typical business use. Sustained use exceeding ten percent (10%) of the allocated host's resources, or use that materially degrades the experience of other customers, is a violation of this AUP. Qilak will give written notice at the 5% threshold where practicable.
b. High-volume outbound traffic. Operating content delivery networks, public file-sharing services, public proxy/VPN exit nodes, or large-scale video streaming services requires advance written approval from Qilak. Unapproved CDN-style use is a violation.
c. IP addresses. IP addresses assigned to Customer remain Qilak's property. Customer must not announce, advertise, or use Qilak IP space outside the Services without written consent. BGP announcements require a Letter of Authorization from the rightful holder of the prefix.
d. DNS and rDNS. Customer is responsible for accurate DNS and reverse DNS records and must not configure DNS in a manner that facilitates abuse.
4. Email Sending
a. Outbound SMTP from VPS and dedicated services may be rate-limited or blocked by default. To enable production email sending, Customer must request approval and demonstrate compliant practices (verified consent, working unsubscribe, accurate headers, valid bounce handling).
b. Customer must comply with CASL, including consent, identification, and unsubscribe requirements, for any commercial electronic message originating from the Services.
c. Listing of Qilak IP space on a major reputation block list (e.g., Spamhaus SBL, XBL, CSS) as a result of Customer activity is a material AUP violation.
5. Adult Content
Pornographic or sexually explicit content is permitted only on dedicated server and colocation Services, only where lawful in both Customer's and the audience's jurisdictions, and only with prior written approval from Qilak. Approval will not be granted for content involving minors, non-consensual material, or content prohibited by Canadian law. Adult content is not permitted on shared, VPS, or web hosting Services.
6. Lawful Interception and Reporting
a. Qilak will respond to lawfully issued Canadian production orders, warrants, and court orders. Where permitted by law, Qilak will give Customer prior notice and an opportunity to object.
b. Qilak cooperates with the Canadian Centre for Child Protection, the RCMP, and other Canadian law enforcement agencies on investigations of illegal content or activity.
c. For non-Canadian requests, Qilak generally requires compliance with the Mutual Legal Assistance Treaty (MLAT) process or equivalent.
7. Copyright Complaints (Notice-and-Notice)
a. Canada operates a "notice-and-notice" regime under sections 41.25–41.27 of the Copyright Act. Qilak will forward properly formed copyright infringement notices to the relevant Customer and retain records as required by law.
b. Submit copyright notices to: [email protected]. Notices must include the information required by section 41.25(2) of the Copyright Act.
c. Qilak does not, under Canadian law, automatically remove allegedly infringing content based on notice-and-notice. However, content that is the subject of a court order, or that is clearly and demonstrably infringing, may be removed under the MSA and this AUP.
8. Abuse Reports
Report suspected abuse to [email protected]. Include:
- The URL, IP address, or hostname involved;
- The nature of the abuse;
- Any relevant headers, logs, or evidence;
- Your contact information.
Qilak will acknowledge legitimate abuse reports within one (1) business day and investigate within five (5) business days. Critical reports (CSAM, active attacks) are escalated immediately.
9. Enforcement
a. Investigation. Qilak may investigate suspected AUP violations and may, as part of that investigation, access Customer Services, logs, and Customer Data to the extent reasonably necessary.
b. Graduated response. For non-critical violations, Qilak's normal response is: (1) written notice and opportunity to cure; (2) suspension; (3) termination. For critical violations (CSAM, active attacks, fraud, immediate legal risk), Qilak may suspend or terminate without prior notice.
c. Reinstatement. Customer may request reinstatement by addressing the underlying issue and submitting a written remediation plan. Qilak is not obligated to reinstate Services.
d. Costs. Customer is responsible for reasonable costs Qilak incurs in investigating and remediating AUP violations caused by Customer, including responding to abuse reports, law enforcement requests, and reputation block list delistings.
10. Changes
Qilak may update this AUP from time to time on at least thirty (30) days' prior notice, except where shorter notice is required to address security, legal, or abuse issues, in which case the AUP is effective on posting.
